            ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO TAKE ALL STEPS NECESSARY TO UTILIZE FULLY THE 2013 (AFG) FIREFIGHTERS ASSISTANCE GRANT INCLUDING COUNCIL DECLARING IT NECESSARY TO UTILIZE, PURSUANT TO ORC 735.051, A REQUEST FOR PROPOSAL PROCESS, APPROPRIATING THE NECESSARY FUNDS AND DECLARING AN EMERGENCY

 

            WHEREAS,  the City of Marion was awarded a 2013 (AFG) Firefighter Assistance Grant in order to update necessary equipment at the Fire Department and resulting in life saving benefits which otherwise would not be enabled, and

 

 

 

            WHEREAS, in order to fully utilize the grant funding the Safety Director has advised it is necessary to utilize a Request for Proposal Process in regard to the acquisition of the subject life saving equipment, and

 

 

 

            BE IT ORDAINED by the Council of the City of Marion, Ohio: Marion County,

 

 

 

            Section 1.  Based upon the report provided by the Safety Director in regard to the 2013 (AFG) Firefighter Assistance Grant and given the Grant’s limited time line, the Council desires to fully utilize the federal grant funding and therefore the Council determines it is necessary as an emergency under ORC 735.051 that the project be let utilizing requests for proposals in order to avoid the communities loss of the grant funds in regard to need to acquire the life saving equipment.  Therefore, the Council declares and emergency and authorizes the Service Director to extend requests for proposals as to the itemized listing contained on Exhibit A attached hereto and made a part hereof and further expressly authorizing the Safety Director to enter into contract with the lowest and best contractor.

 

 

 

            Section 2.  The cost of the project shall be payable from the 2013 (AFG) Firefighter Assistance Grant and by Appropriating the necessary matching funds from the City's Capital Improvement Fund, more specifically:

            Section 3.  This Ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and its inhabitants thereof:   Due to the real and present need to move forward without delay given the imminent loss of the grant funds which will be detrimental to the citizens of Marion, Ohio; and as such shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
