ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO EXECUTE AN EASEMENT TO THE BENEFIT OF THE OWNER(S) OF LOT 11366 AND A PORTION OF 14165 WITHIN THE BUDAY SUBDIVISION TO THE CITY OF MARION TO PROVIDE A NECESSSARY RESIDENTIAL SANITARY SEWER ACCESS POINT TO RE-GAIN SERVICE AS NO OTHER REASONABLE ALTERNATIVE EXISTS AND DECLARING AN EMERGENCY

 

WHEREAS, Council was recently advised that a previous split lot within the Buday Subdivision was being served by a sanitary sewer line which ran under a neighboring property's basement and the owner of the served lot was in need of re-configuring her access to the City system, and

 

 

 

WHEREAS, the City Engineer and City Wastewater Superintendent reviewed the submittal received from the owner's consultant and has approved the planned sanitary sewer easement necessary to re-store service to the existing residential premises,

 

 

 

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

 

 

 

Section 1.        The Council finds it necessary and beneficial on behalf of the citizens of the City of Marion, Ohio to authorize the Service Director to execute  an easement agreement, approved by the Law Director, granting to the owners of Lot 14165 also containing a portion of Lot 11366 within the Buday Subdivision a sanitary sewer easement along the western border of the City's McKinley Park consistent with the proposal and discussion related hereto in order for the affected resident to re-gain access to the City Sanitary Sewer system, all at her costs.  Supporting documents being attached as Exhibit A & B.

 

 

 

Section 2.        That this ordinance is hereby declared to be an emergency measure necessary for the safety and welfare of the City of Marion given the need to move forward to ensure the previously served residential structure is re-stored a functional sanitary sewer access point and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council, otherwise it shall become effective from and after the earliest period allowed by law.
