MARION CITY COUNCIL MEETING

 

 

City Hall – Council Chambers on November 28, 2016, 7:30 PM

ROLL CALL - 9 members answered – Mr. Cumston, Mr. Ratliff, Mr. Thomas, Ms. Blevins, Ms. Cunningham, Mr. Huddle, Mr. Daniels, Mr. Norris, Dr. Gray; Ms. Gustin is absent.

Summary of Proceedings from November 14, 2016 – Mr. Cumston moved to approve, Mr. Thomas 2nd. Roll call: Ayes all, motion carried. Summary is approved.

NEW BUSINESS:

ORDINANCE 2016- 80:

ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO EXECUTE AN EASEMENT TO THE OWNERS OF LOT 2588 ALSO KNOW AS 542 N. GREENWOOD TO THE CITY OF MARION TO INCLUDE A WHEELCHAIR ENCROACHMENT TO THE CITY'S RIGHT OF WAY ON VAN BUREN ST AND DECLARING AN EMERGENCY

Ms. Blevins spoke: this came before our committee with a 2-0 recommendation for approval, I’d like to suspend, Mr. Cumston 2nd. Roll call: Ayes all, motion carried.

Sulu Kelley said there are alternate routes to locate this ramp, also liability waiver to the city should be available. Also the destruction of the ramp when that person is no longer there, will there be funds for that? Mr. Russell said we mentioned that we’d leave the item of the insurance up to City Council to have the city as an additional name on their insurance. In regards to the 2nd part, I believe there is more than one person, it’s depending on that remaining person. Ms. Blevins asked about it not being placed there. Mr. Russell said you may want to look at the lot yourself. It’s a question of discretion. Mr. Kelley explained the different configuration of the ramp. Mr. Cumston said he went and looked at that today, it being on the side because of the car parking, the individual having access to their vehicle. That was the reason for that side, I would hate to hang this up for a disabled person. Mr. Ratliff said he went and looked at it also. Clerk explained to Council that this individual building the ramp has worked with the Council on Aging for the past 10 years, this is his job, he doesn’t do anything else except ramps. Ms. Blevins said he feels that they need it – about the insurance though, that is my concern. Mr. Russell said you make the motion to amend to add the City of Marion to his homeowner policy.

Mr. Daniels said we go to the great extent to help people that are handicapped. There are plenty of Utility companies with obstructions in our easement. We don’t require insurance for telephone poles. I would like to make this simple as possible – not require insurance. I would vote to allow the encroachment of the easement. I would like to accommodate this person.

Ms. Blevins moved to adopt, Mr. Daniels 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2016-80 IS ADOPTED

  

ORDINANCE 2016- 81:

ORDINANCE TO VACATE A 16’ WIDE EAST/WEST ALLEY AND 10’ WIDE NORTHWESTERLY ALLEY BETWEEN TOLEDO AVE AND GAY STREETS (LOT #’S 3612 AND 3613) PURSUANT TO ORC 723.041 RETAINING PERMANENT EASEMENT RIGHTS (Applicant, Robert Jordan)

          Ms. Blevins said this came out of Streets & Sewers with a 2-0 approval, I’ll ask for a 1st reading tonight with a Public Hearing to be held on December 27, 2016. ORDINANCE 2016-81 HAS HAD ITS FIRST READING

Mayor Schertzer spoke on the OSU Columbus issue. How the Marion Police and Marion County Sheriff’s office stepped up and sent over to OSU Marion Campus 2 persons to take over the security there while the local Marion Campus security went to OSU Columbus. Thank you.
