ROLL CALL - 9 members answered – Mr. Cumston, Mr. Ratliff, Mr. Thomas, Ms. Blevins, Ms. Cunningham, Mr. Daniels, Mr. Norris, Ms. Gustin, Dr. Gray; Mr. Huddle is absent.

Summary of Proceedings from November 28, 2016 – Mr. Cumston moved to approve, Mr. Thomas 2nd. Roll call: Ayes all, motion carried. Summary is approved.

 

Mr. Cumston noted that Council needed to add an Ordinance this evening: 2016-85, Mr. Thomas 2nd, Mr. Ratliff 3rd. ORDINANCE 2016-85 IS ADDED TO TONIGHT’S AGENDA

 

OLD BUSINESS:

 

Item 1.         ORDINANCE 2016- 81:     ORDINANCE TO VACATE A 16’ WIDE EAST/WEST ALLEY AND 10’ WIDE NORTHWESTERLY ALLEY BETWEEN TOLEDO AVE AND GAY STREETS (LOT #’S 3612 AND 3613) PURSUANT TO ORC 723.041 RETAINING PERMANENT EASEMENT RIGHTS (Applicant, Robert Jordan)

          Ms. Blevins spoke: This came out of Streets & Sewers with a 2-0 approval, this will be the 2nd reading tonight, we will have a public hearing on December 27th. ORDINANCE 2016-81 HAS HAD ITS 2ND READING

 

NEW BUSINESS:

 

RESOLUTION 2016-25:

RESOLUTION CONFIRMING THE RE-APPOINTMENT, BY THE MAYOR, OF TARA DYER, TO SERVE AS A MEMBER OF THE MARION COUNTY GENERAL HEALTH DISTRICT

Mayor Schertzer spoke:     Asking the Council to support Tara Dyer for the Health District again.  Mr. Cumston moved to suspend, Mr. Thomas 2nd. Roll call: Ayes all, motion carried.

Mr. Cumston moved to adopt, Mr. Ratliff 2nd. Roll call: Ayes all, motion carried. RESOLUTION 2016-25 IS ADOPTED

 

ORDINANCE 2016-82:

ORDINANCE ENACTED BY THE CITY OF MARION, MARION COUNTY, OHIO, HEREINAFTER REFERRED TO AS THE LOCAL PUBLIC AGENCY (LPA), IN THE MATTER OF RESURFACING SR95 AND SR309 DESCRIBED BELOW, AND DECLARING AN EMERGENCY

          Mr. Thomas said this came out of Streets and Sewers with a 3-0 approval; I’ll move to suspend the rules, Ms. Blevins 2nd. Roll call: Ayes all, motion carried.

          Mr. Thomas moved to adopt, Ms. Blevins 2nd. Roll Call: Ayes all, motion carried. ORDINANCE 2016-82 IS ADOPTED

 

ORDINANCE 2017-01:

ORDINANCE TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE CITY OF MARION, STATE OF OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2017

          Mr. Cumston stated that this came out of Finance with a 3-0 approval, we are going to have a first reading tonight, on the 27th, we’ll look at passing it if there has been any change before that. ORDINANCE 2017-01 HAS HAD ITS FIRST READING

 

ORDINANCE 2016-85

ORDINANCE AUTHORIZING THE CITY LAW DIRECTOR TO FILE COMPLAINT TO APPROPRIATE THE REMAINDER FEE SIMPLE TITLE AND LESSER REAL PROPERTY INTERESTS NECESSARY FOR THE CITY’S DEPARTMENT OF PUBLIC SERVICE FOR WEST CENTER PAVING PROJECT 2017; AUTHORIZES THE CITY LAW DIRECTOR TO SPEND FUNDS FROM THE CITY’S DEPARTMENT OF PUBLIC SERVICE FEDERAL STATE ENGINEERING FUND, FUND NUMBER 765 AND DECLARING AN EMERGENCY

          Mr. Russell spoke: We needed to add this evening, we already passed the ordinance for the ODOT 2017 paving project. The intersection corners with the ADA ramps – this property does not have an owner; it ceases to exist; we are temporally accessing the property for the ramps. This coincides with the 2017 paving project.

          Mr. Thomas moved to suspend Rule 56, Mr. Cumston 2nd. Roll call: Ayes all, motion carried.
