ROLL CALL - 8 members answered – Mr. Cumston, Mr. Ratliff, Ms. Blevins, Ms. Cunningham, Mr. Norris, Mr. Daniels, Ms. Gustin Dr. Gray; Mr. Thomas and Mr. Huddle are absent.

Summary of Proceedings from January 9, 2017 – Mr. Cumston moved to approve, Ms. Blevins 2nd. Roll call: Ayes all, motion carried. Summary is approved.

 

OLD BUSINESS:

ORDINANCE 2016-48:

ORDINANCE AMENDING MARION CITY CODE SECTION 941.16 DIRECTOR OF AVIATION IN ORDER TO BRING SAME MORE UP TO DATE, as amended

Mr. Ratliff said this came out of Committee with a 2-0 approval, this is the 3rd reading, I moved to adopt, Mr. Cumston 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2016-48 IS ADOPTED.

 

RESOLUTION 2017-01:

RESOLUTION REAFFIRMING SUPPORT OF MARION CITY COUNCIL FOR ORDINANCE 2016-12, “TO AMEND A MODERATE COMMUNITY REINVESTMENT AREA #2 IN THE CITY OF MARION BY ADDING TWO SMALL AREAS TO THE EXISTING DISTRICT AND DECLARING AN EMERGENCY

            Mr. Ratliff said this came out of Committee on February of 2016, we passed it then, we need to react on this again. This is still what we proposed and like to do. I’ll moved to suspend, Mr. Cumston 2nd. Roll call: Ayes: Mr. Cumston, Mr. Ratliff, Ms. Blevins, Ms. Cunningham, Mr. Norris, Ms. Gustin; Abstain: Mr. Daniels. RESOLUTION 2017-01 HAS HAD ITS FIRST READING

 

RESOLUTION 2017-02:

RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR TO APPLY TO THE MARION COUNTY COMMISSIONERS FOR MONIES DERIVED FROM THE AUTOMOBILE LICENSE TAX, AND DECLARING AN EMERGENCY

            Ms. Blevins stated that this came out of Streets & Sewers with a 3-0 recommendation for approval; this is the tax money to pave our streets. I’ll move to suspend, Ms. Cunningham 2nd. Roll Call: Ayes all, motion carried.

            Ms. Blevins moved to adopt, Mr. Cumston 2nd. Roll Call: Ayes all, motion carried. RESOLUTION 2017-02 IS ADOPTED

 

ORDINANCE 2017-02:

ORDINANCE ENACTED BY THE CITY OF MARION, MARION COUNTY, OHIO, HEREINAFTER REFERRED TO AS THE LOCAL PUBLIC AGENCY (LPA), IN THE MATTER OF RESURFACING SR 95 STATED BELOW

Ms. Blevins stated that this came out of Streets & Sewers with a 3-0 recommendation for approval, I’ll move to suspend, Ms. Cunningham 2nd. Roll Call: Ayes all, motion carried.

            Ms. Blevins moved to adopt, Mr. Cumston 2nd. Roll Call: Ayes all, motion carried. ORDINANCE 2017-02 IS ADOPTED

 

ORDINANCE 2017-03:

ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO ENTER INTO AN UPDATED REPLACEMENT CONTRACT WITH THE COUNTY COMMISSIONERS, REQUESTED BY THE OHIO PUBLIC DEFENDER'S OFFICE, TO PROVIDE FOR REIMBURSEMENT FROM THE STATE OF OHIO FOR ATTORNEYS APPOINTED FOR INDIGENT PERSONS CHARGED IN THE MARION MUNICIPAL COURT

Mr. Cumston said this came out of Finance with a 2-0 recommendation for approval, I’ll moved to suspend, Ms. Cunningham 2nd; Roll call: Ayes all, motion carried.

Mr. Cumston moved to adopt, Ms. Cunningham 2nd.  Roll Call: Ayes all, motion carried. ORDINANCE 2017-03 IS ADOPTED

 

ORDINANCE 2017-04:

ORDINANCE RE-DECLARING THE CITY OF MARION’S SUPPORT FOR CAN DO! IN ORDER TO CONTINUE THE ECONOMIC PROSPERITY OF THE GREATER MARION AREA, AND DECLARING AN EMERGENCY

Mr. Ratliff said this came out of Committee with a 3-0 recommendation for approval, I’ll moved to suspend, Ms. Cunningham 2nd; Roll call: Ayes all, motion carried.

Mr. Ratliff moved to adopt, Mr. Cumston 2nd.  Roll Call: Ayes all, motion carried. ORDINANCE 2017-04 IS ADOPTED

 

ORDINANCE 2017-05:

ORDINANCE RE-DECLARING THE CITY OF MARION’S SUPPORT FOR DOWNTOWN MARION, INC., INCLUDING BUT NOT LIMITED TO FINANCIAL SUPPORT IN ORDER TO CONTINUE THE COMMUNITY’S EFFORTS TO REVITALIZE THE DOWNTOWN AREA, AND DECLARING AN EMERGENCY

Mr. Ratliff said this came out of Committee with a 3-0 recommendation for approval, I’ll moved to suspend, Ms. Cunningham 2nd; Roll call: Ayes all, motion carried.

Mr. Ratliff moved to adopt, Mr. Cumston 2nd.  Roll Call: Ayes all, motion carried. ORDINANCE 2017-05 IS ADOPTED

 

ORDINANCE 2017-06:

ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO DISPOSE OF ONE SNORKEL TRUCK USED BY THE FIRE DEPARTMENT AND GRANTING AUTHORIZATION TO SELL SAID VEHICLE AND EQUIPMENT ON THE OPEN MARKET, UPON SUCH TERMS AND AT SUCH PRICES AS ARE DEEMED MOST ADVANTAGEOUS TO THE CITY OF MARION AND DECLARING AN EMERGENCY

Mr. Cumston said this came out of Finance with a 2-0 recommendation for approval, I’ll moved to suspend, Ms. Cunningham 2nd; Roll call: Ayes all, motion carried.
