Summary of Proceedings for April 11 2016, Mr. Cumston moved, Ms. Cunningham 2nd. Roll call: Ayes All, motion carried. Summary is approved.

 

Mr. Cumston noted that an item needs to added to tonight’s agenda, 2016-38, Mr. Ratliff 2nd. Mr. Thomas 3rd.

 

OLD BUSINESS:

 

ORDINANCE 2016-36

ORDINANCE CREATING MARION CITY CODE CHAPTER 1112 TITLED DOWNTOWN BUSINESS DISTRICT SIDEWALK USE REGULATIONS, CREATING REGULATIONS FOR THE TEMPORARY USE OF SIDEWALKS CURRENTLY CODIFIED IN CHAPTER 660 HEALTH, SAFETY AND SANITATION, as amended

          Mr. Daniels stated that this came out of Codes with a 3-0 approval to send onto Council, I’ll ask Ken to talk on this, this is the 2nd reading. Mr. Lengieza said this will come before City Planning on Tuesday, May 3, 2016. Mr. Daniels said I’ll ask for a 2nd reading tonight. Mr. Osborn asked if there is a staff report on this. Mr. Lengieza said that Irene would have emailed out to you sometime today.  Will have to go to City Planning on Tuesday, the law director changed the chapter – it doesn’t have to be in the Zoning Code per say because it’s not on private property. It’s still under the planning zoning laws, but not under the Zoning Code. The other thing is the word temporary – some of the business owners wants, permanent – they would want some assurance to keep it more than a few months, possible for a few years if they put it in right according to regulations and is maintained.  ORDINANCE 2016-36 HAS RECEIVED ITS 2ND READING

         

ORDINANCE 2016-37

ORDINANCE AMENDING ORDINANCE 2015-17 WHICH CHANGED SALARIES FOR AQUATICS CENTER, AND DECLARING AN EMERGENCY

          Mr. Cumston stated this came out of Finance with a 2-0 recommendation of approval, I’ll move to suspend, Mr. Thomas 2nd.

          Mr. Cumston moved to adopt, Ms. Gustin 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2016-37 IS ADOPTED

 

ORDINANCE 2016-38

ORDINANCE RATIFYING AND APPROVING THE BARGAINING AGREEEMENT BETWEEN THE CITY OF MARION AND AFSCME LOCAL 1158 AND DECLARING AN EMERGENCY

          Mr. Cumston moved to waive Rule 56, Mr. Ratliff 2nd. Roll call: Ayes all, motion carried.

          Mr. Cumston moved to suspend, Mr. Thomas 2nd.

          Mr. Robbins spoke: It was productive, meeting this all AFSCME persons. It looks pretty good. We are aligning them with all the other contracts. Health care insurance is at an 85/15 – at the end of this contract they will be aligned. There is a 2.5 % increase in 2016; 2% in 17 and 2% in 18. Rate adjustments in the Transit Dept. and the longevity pay at 5 cents an hour. Shift differential for 2nd and 3rd shift, we extended that. We extended the probationary period from 90 days to an entire year. That aligns with most of the other groups. I’ll ask for your consideration tonight. Mr. Thomas asked how they voted on this. Mr. Robbins said probably 45 for it and 25 against the Mayor said. Mr. Thomas said I’m curious with the 1 probation period. Mr. Robbins said they are still represented by the union. Mayor said I looked on my phone - 42 for it and 25 against it. Mr. Robbins said I’m just trying to align every one up. It would give us a better look for the employees. Once you get to the 90-day period, you’re stuck.
