MARION CITY COUNCIL MEETING

City Hall – Council Chambers on September 25, 2017, 7:30 PM

ROLL CALL - 10 members answered – Mr. Cumston, Mr. Ratliff; Mr. Thomas, Ms. Blevins, Ms. Cunningham, Mr. Huddle,  Mr. Norris, Mr. Daniels, Ms. Gustin, Ms. Fisher.

PRAYER WAS LED BY PASTOR JASON QWAST OF FAMILY LIFE CHURCH

Mayor Schertzer presented a proclamation to Ms. Jenifer Ramey of Kirkpatrick Food Pantry for Hunger Action Month.

Summary of Proceedings from September 11, 2017 – Mr. Cumston moved to approve, Mr. Thomas 2nd. Roll call: Ayes all, motion carried. Summary is approved.

NEW BUSINESS:

ORDINANCE 2017-49:

ORDINANCE MAKING AN ADDITIONAL APPROPRIATION IN THE KAUFMAN DOG PARK FUND FOR THE YEAR ENDING DECEMBER 31, 2017

          Mr. Cumston noted that this came out of Finance with a 3-0 recommendation for approval, I’ll move to suspend, Ms. Cunningham 2nd. Roll call: Ayes all, motion carried.

          Mr. Cumston moved to adopt, Ms. Cunningham 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2017-49 IS ADOPTED

ORDINANCE 2017-50:

ORDINANCE MAKING ADDITIONAL APPROPRIATIONS IN THE POLICE DEPARTMENT FUND FOR THE YEAR ENDING DECEMBER 31, 2017

Mr. Cumston noted that this came out of Finance with a 3-0 recommendation for approval, I’ll move to suspend, Ms. Cunningham 2nd. Roll call: Ayes all, motion carried.

          Mr. Cumston moved to adopt, Ms. Gustin 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2017-50 IS ADOPTED

ORDINANCE 2017-51:

ORDINANCE AUTHORIZING THE PUBLIC WORKS DIRECTOR TO PROCEED IN REGARD TO THE UHLER RD. DIVERSION RELATED TO THE FAILED UNAPPROVED PRIVATE BY-PASS OF THE STORM SEWER SYSTEM, IT BEING DECLARED AN EMERGENCY NECESSARY TO PROCEED WITHOUT FORMAL BIDDING AND ADVERTISING PURSUANT TO ORC 735.051, AND DECLARING AN EMERGENCY

            Mr. Thomas stated that this was in Streets & Sewers and came out with a 3-0 recommendation for Council approval, and I understand there is additional discussion on this.

            Mr. Daniels moved to go into executive session for it concerns real estate and to add as an additional reason of threatened litigation from Mr. Russell.

            Mr. Norris 2nd, roll call: Ayes all, motion carried.

CITY COUNCIL WENT INTO EXECUTIVE SESSION AT 7:42 PM

CITY COUNCIL RECONVENED AT 8:19 PM.

Mr. Thomas noted again that this came out of Committee with a 3-0 recommendation, I’ll call for a 1st reading tonight. ORDINANCE 2017-51 HAS HAD ITS 1ST READING

Matters not on the Agenda:

Mr. Shawn Oesterle, 534 Nassau Dr. spoke about being stopped by the Police at 5:30 AM while walking with his wife on the streets in Fairpark. He was upset that he was stopped for no reason. Officer Gosnell stated he was jay-walking. No citation was given.
