MARION CITY COUNCIL MEETING

City Hall – Council Chambers on October 9, 2017, 7:30 PM

ROLL CALL - 10 members answered – Mr. Cumston, Mr. Ratliff; Mr. Thomas, Ms. Blevins, Ms. Cunningham, Mr. Huddle,  Mr. Norris, Mr. Daniels, Ms. Gustin, Ms. Fisher.

PRAYER WAS LED BY PASTOR TOM TONEY OF FAMILY LIFE CHURCH

Probation Officer James Boleyn presented to Council the Adult Drug Court Discretionary Grant Program totaling $339,000.00 that will be awarded to the Probation Department.

Summary of Proceedings from September 25, 2017 – Mr. Cumston moved to approve, Mr. Thomas 2nd. Roll call: Ayes all, motion carried. Summary is approved.

NEW BUSINESS:

ORDINANCE 2017-52:

ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO PREPARE SPECIFICATIONS AND ADVERTISE FOR BIDS FOR THE PURCHASE OF THREE (3) MARKED POLICE VEHICLES AND ONE (1) UNMARKED POLICE VEHICLE, AND DECLARING AN EMERGENCY

          Mr. Cumston stated this came out of Finance with a 3-0 recommendation for approval, I’ll move to suspend, Ms. Cunningham 2nd; Roll call: Ayes all, motion carried.

          Mr. Cumston moved to adopt, Ms. Cunningham 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2017-52 IS ADOPTED

ORDINANCE 2017-53:

ORDINANCE MAKING ADDITIONAL APPROPRIATIONS IN THE LAW ENFORCEMENT TRUST FUND FOR THE YEAR ENDING DECEMBER 31, 2017

Mr. Cumston stated this came out of Finance with a 3-0 recommendation for approval, I’ll move to suspend, Mr. Huddle 2nd; Roll call: Ayes all, motion carried.

          Mr. Cumston moved to adopt, Mr. Norris 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2017-53 IS ADOPTED

ORDINANCE 2017-54:

ORDINANCE MAKING AN APPROPRIATION TO THE MARION MUNICIPAL COURT GENERAL FUND FOR THE YEAR 2017

Mr. Cumston stated this came out of Finance with a 3-0 recommendation for approval, I’ll move to suspend, Mr. Norris 2nd; Roll call: Ayes all, motion carried.

          Mr. Cumston moved to adopt, Mr. Huddle 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2017-54 IS ADOPTED

ORDINANCE 2017-55:

ORDINANCE AUTHORIZING AND DIRECTING THE PUBLIC WORKS DIRECTOR TO ENTER INTO CONTRACT WITH UNDERGROUND UTILITIES, INC. FOR THE HANE AVENUE SEWER IMPROVEMENTS PROJECT 17-1S FOR THE CITY OF MARION, OHIO, APPROPRIATING NECESSARY FUNDS, AND DECLARING AN EMERGENCY

Mr. Thomas stated this came out of Streets & Sewers with a 3-0 recommendation for approval, I’ll move to suspend, Ms. Blevins 2nd; Roll call: Ayes all, motion carried.

Mr. Thomas asked PW Director Bischoff if he has the numbers on the separation. Mr. Bischoff said 41% is storm sewer and 59% is sanitary. The total amount is 595.000.00

Mr. Ratliff asked if this is going onto a next bond issue? Mr. Bischoff said no – it will be OPWC monies.

          Mr. Cumston moved to adopt, Ms. Blevins 2nd. Roll call: Ayes all, motion carried. ORDINANCE 2017-55 IS ADOPTED

Matters not on the Agenda:

Fire Chief Deem spoke about budget for 2017- we started behind the 8 ball this year, we did ask for money for overtime and radios – that is true. There should be budgetary equality for both the Fire and Police Depts. in the future.

                    threatened litigation.

OLD BUSINESS:

ORDINANCE 2017-51:

ORDINANCE AUTHORIZING THE PUBLIC WORKS DIRECTOR TO PROCEED IN REGARD TO THE UHLER RD. DIVERSION RELATED TO THE FAILED UNAPPROVED PRIVATE BY-PASS OF THE STORM SEWER SYSTEM, IT BEING DECLARED AN EMERGENCY NECESSARY TO PROCEED WITHOUT FORMAL BIDDING AND ADVERTISING PURSUANT TO ORC 735.051, AND DECLARING AN EMERGENCY

Mr. Thomas stated that we will have a 2nd READING ON ORDINANCE 2017-51 tonight.
